This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us or otherwise collected by us, offline or online including through this website, landing page or lead capture page/form made available via third party platforms including but not limited to Meta (Site). In this Privacy Policy ‘you’ means any party that provides personal information to us and ‘we’ or ‘us’ means Scribble Finance PTY LTD (ABN 70 643 769 920), successors and assignees.

By providing personal information to us, you consent to our collection, holding, selling, use and disclosure of your personal information (including any sensitive information where applicable and permitted by law) in accordance with this Privacy Policy. For the purposes of this Privacy Policy and our Site Terms of Use, ‘personal information’ is defined as any information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not, and whether recorded in a material form or not, as outlined under the Privacy Act.

Personal information: For the purposes of our services, we collect the following categories of personal information, which include both traditional personal details and business-related information:

• credit score (ranging from excellent to poor).

• third parties to collect and process data such as Google Analytics or other relevant businesses. This may include parties that store data outside of Australia.

Details of Third Parties: Your personal information will be sold to commercial finance brokerages, residential/mortgage brokerages and lenders. Your personal information may be sold to various types of third parties, including other finance services such as private credit firms, accountants and bookkeeping services as well as lawyers, consultancy agencies, business consultants, marketing agencies, and other businesses that may offer products or services in which you might be interested. These third parties may use your data for direct marketing. Your personal information may be disclosed to third parties outside Australia, including Serbia, UK, USA, Thailand, New Zealand and the Philippines. By submitting your personal information, you acknowledge that overseas recipients may not be subject to Australian privacy laws and agree to such disclosures.

Where we disclose or sell your personal information to third parties for these purposes, we will request that the third party follow this Privacy Policy regarding handling of your personal information.

If there is a change of control of our business or a sale or transfer of business assets, we reserve the right to transfer our user databases, together with any personal information and non-personal information contained in those databases, to the extent permissible by law. This information may be disclosed to a potential purchaser. We would seek to only disclose information in good faith. 

4. How we treat personal information that is also sensitive information

Information classified as “Sensitive information” is generally afforded a higher level of privacy protection under the APPs than other personal information (for example, see APPs 3, 6 and 7). This recognises that inappropriate handling of sensitive information can have adverse consequences for an individual or those associated with the individual.

Sensitive information: ‘Sensitive information’ is a subset of personal information and is defined as:

• information or an opinion (that is also personal information) about an individual’s:
  • racial or ethnic origin
  • political opinions
  • membership of a political association
  • religious beliefs or affiliations
  • philosophical beliefs
  • membership of a professional or trade association
  • membership of a trade union
  • sexual orientation or practices, or
  • criminal record
• health information about an individual (see paragraphs B.74–B.78)
• genetic information (that is not otherwise health information)
• biometric information that is to be used for the purpose of automated biometric verification or biometric identification, or
• biometric templates (s 6(1)).

We only collect, hold, use and disclose sensitive information for the following purposes:

• the primary purpose for which it is collected, to provide our services to you;
• secondary purposes that are directly related to the primary purpose for which it was collected, including disclosure to the below listed third parties as reasonably necessary to do business with you; 
• to contact emergency services, or to speak with your family, partner or support person where we reasonably believe there is a serious risk to the life, health or safety of you or another person and it is impracticable for us to obtain your consent; and
• if otherwise required or authorised by law including where we are required to do so under a law that applies to our business.

4.1 The Purpose of Collecting, Retaining, Using And Disclosing Your Personal Information

We collect, hold, use and disclose your personal information to meet legislative requirements, where it is in our legitimate interests to do so and primarily to facilitate the core services of our lead generation business, which includes selling leads to third-party businesses as well as our affiliated companies. Our collection and use of personal information are aimed at providing you with targeted opportunities and enhancing the services offered by our partners.

We use, share and sell personal information (including in some cases, sensitive information) for reasons including:

• to enhance the services we offer you;
• to sell to third parties that we believe may be of interest to you to provide you with opportunities to purchase products or services from said third parties;

• management and administration of ongoing products and services;
• obtaining a credit report or other information from a credit reporting agency or financial services provider to assess an application for a credit related service made by you;
• for analytics purposes to develop our understanding of our customers and the market in which we operate;

• complying with obligations that we may have under laws that apply to our business or to meet reasonable requests from regulatory bodies which regulate our business, such as preparing player activity statements and monitoring the responsible provision of gambling services in our premises, including the exclusion of patrons from our premises; and

The sale of such information is conducted transparently and in accordance with privacy laws, ensuring that all parties respect and uphold the confidentiality and security of the data.

5. Your rights and controlling your personal information

Choice and consent: Providing us with your personal information is optional to you.  You can choose not to provide personal information. When you provide us with your personal information, you consent to the terms in this Privacy Policy, and to us disclosing or receiving your personal information for these purposes.

Your provision of third-party information: If you provide us with third party personal information then you warrant to us that you have the third party’s consent to provide this.

By submitting your personal information on this Site, you consent to us selling your personal information to third parties. If you do not agree to this use of your personal information, please do not provide your details. If you have already submitted your information and decide to opt out, you must notify us as soon as possible. Please contact us to opt out. We will cease the sale of your information upon receipt of your opt-out request; however, we cannot retract information that has already been sold prior to the receipt of your request. We recommend opting out at your earliest convenience to minimise potential sales of your data.

Access: You may request details of personal information that we hold about you, in certain circumstances set out in the Privacy Act 1988 (Cth) (Privacy Act). An administrative fee may be payable for the provision of information. We may refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act. 

Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us by email. We rely in part upon customers advising us when their personal information changes. We will respond to any request within a reasonable time. We will endeavour to promptly correct any information found to be inaccurate, incomplete or out of date.

Complaints: If you believe that we have breached the Australian Privacy Principles and wish to make a complaint about that breach, please contact us by email setting out details of the breach. We will promptly investigate your complaint and respond to you in writing setting out the outcome of our investigation, what steps we propose to take to remedy the breach and any other action we will take to deal with your complaint.

We are committed to ensuring that the information you provide is secure. 7. Cookies & Web Beacons

We may use cookies on this Site from time to time. Cookies are text files placed in your computer’s browser to store your preferences. Cookies, by themselves, do not tell us your e-mail address or other personally identifiable information. However, they do allow third parties such as Google and Facebook to cause our advertisements to appear on your social media and online media feeds as part of our retargeting campaigns. If and when you choose to provide the Site with personal information, this information may be linked to the data stored in the cookie.

We may use web beacons on this Site from time to time. Web beacons or clear.gifs are small pieces of code placed on a web page to monitor the visitors’ behaviour and collect data about the visitors viewing a web page. This Privacy Policy may be amended, including with changes, additions and deletions, from time to time in our sole discretion. Your continued use of our Site following any amendments indicates that you accept the amendments. You should check this Privacy Policy regularly, prior to providing personal information, to ensure you are aware of any changes, and only proceed to provide personal information if you accept the new Privacy Policy.
